DMCA and Takedown Policy

XAN Enterprises Limited, a Hong Kong company (Company Number 80174645) with its registered office at Unit 1603, 16/F, The L. Plaza, 367-375 Queen’s Road Central, Sheung Wan, Hong Kong, trading as Mirai (“Mirai”) respects the intellectual-property rights, personality rights, and privacy of others. This policy explains how to report content on the Mirai platform (the “Platform”) that you believe infringes your rights, and how Mirai responds.
1. Who may file a notice
You may submit a notice if you are the rights-holder (or an authorised agent) of material that appears on the Platform, if you find an AI-generated image that depicts you without your consent, or if you believe a user is infringing a trademark, copyright, or other right you own or control.
2. How to submit a notice
Email your notice to dmca@miraitalent.ai. To meet the requirements of the United States Digital Millennium Copyright Act (17 U.S.C. § 512) and for equivalent processes in other jurisdictions, include the following:
- Your full legal name, mailing address, phone number, and email address.
- A clear identification of the copyrighted work or right you claim is infringed. A single representative example is fine for multiple occurrences; please enumerate the rest.
- A clear identification of the content on the Platform you are asking us to remove, including direct URLs, image IDs, and screenshots where possible.
- A statement in good faith that the use complained of is not authorised by the rights-holder, its agent, or the law.
- A statement under penalty of perjury that the information in your notice is accurate and that you are the rights-holder or authorised to act on behalf of the rights-holder.
- A physical or electronic signature.
3. Likeness and personality rights
If you are reporting an AI-generated image that depicts you or someone you represent without consent, please include a clear recent photograph of the person, a statement of your relationship to them, and any relevant jurisdictional context (for example, a right-of-publicity claim in the United States or a personality-rights claim in a civil-law jurisdiction). We treat unauthorised likeness reports with the same priority as copyright notices and typically act within 24 to 72 hours of receipt.
4. What happens next
Mirai acknowledges every valid notice within three (3) business days. If the notice meets the requirements above, we will remove or disable access to the reported content, notify the user who uploaded or generated it, and provide a copy of your notice to them. For AI-generated content, we may additionally pause generation on the associated Talent model and review the prompts used.
5. Counter-notice
If you believe your content was removed in error, you may submit a counter-notice to dmca@miraitalent.ai that includes:
- Your name, address, phone number, and email.
- Identification of the removed material and its former location on the Platform.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Consent to the jurisdiction of the federal district court for your address, or Hong Kong SAR if you reside outside the United States, and acceptance of service from the original complainant.
- A physical or electronic signature.
Upon receipt of a valid counter-notice, Mirai forwards it to the original complainant. If the complainant does not file a court action within ten (10) business days, we may restore the removed content.
6. Repeat infringers
Mirai terminates the accounts of users who are the subject of repeated, substantiated notices. “Repeated” means three or more substantiated notices within any rolling twelve-month period, or any single notice that involves a serious violation such as child-safety material or sexualised deepfakes. Termination includes forfeiture of unused credits as permitted by law.

8. Bad-faith notices
Under 17 U.S.C. § 512(f) and equivalent laws, any person who knowingly materially misrepresents infringement in a notice or counter-notice may be liable for damages. Please consult a lawyer if you are uncertain whether your claim is valid.
